These Terms and Conditions apply to the use of the Auld Road Motoring Co. website and the purchase and use of digital resources sold by Auld Road Motoring Co., including products purchased through Payhip.

By purchasing, downloading or using one of our resources, you agree to these Terms and Conditions.

 

1. About us

These resources are supplied by Auld Road Motoring Co. In these terms, “we”, “us” and “our” refer to Auld Road Motoring Co. “You” and “your” refer to the customer purchasing or using a resource.

 

2. Our resources

We create digital teaching and reference resources for driving instructors, trainee instructors and other road-safety professionals.

Products may include:

• road-layout and roundabout diagrams;

• route and junction illustrations;

• teaching presentations and handouts;

• printable resources;

• animations or videos;

• bundled resource packs; and

• other downloadable instructional materials.

 

The exact contents and file formats supplied are described on the relevant product page. Please check that your device and software can open the stated file formats before purchasing.

 

3. Educational use and road accuracy

Our resources are intended to support teaching, lesson planning and discussion. They are supplementary teaching aids and are not substitutes for:

• current roadside signs and road markings;

• the Highway Code;

• applicable road traffic law;

• guidance issued by the DVSA or another relevant authority;

• an instructor’s professional judgement; or

• direct observation of current road conditions.

 

Road layouts, lane markings, traffic lights, signs, speed limits and traffic restrictions can change.

Each location-based resource may include an information-check date or version date. This means that the resource was prepared using information reasonably available to us at that time. It does not guarantee that every feature remains unchanged when the resource is used.

 

Instructors and learners must always follow current roadside information, traffic regulations and prevailing conditions.

 

4. Licensing 

When you purchase a resource, you are purchasing a license to use it. You are not purchasing ownership of the artwork, design or intellectual property as that solely belong to Auld Road Motoring Co. Unless a product page states otherwise, each purchase includes a single-instructor license.

Under this license, the named purchaser may:

• use the resource during their own driving lessons;

• display it on their own phone, tablet, laptop or in-car device;

• print reasonable copies for their own teaching use;

• provide a printed copy to an individual learner during a lesson;

• annotate a printed copy for teaching purposes; and

• retain the resource for their own ongoing professional use.

 

A purchase does not provide a license for an entire driving school, franchise, company, instructor team or training organization. Additional licenses may be available, if such case, please contact us.

 

5. Restrictions of use

You must not in any circumstances:

• share the original digital files with another instructor or third party;

• upload the files to a shared school drive, group chat, social-media group, forum or resource library;

• resell, redistribute, sublicense or give away the resources;

• claim the resource, artwork or design as your own;

• remove or obscure copyright notices, watermarks or branding;

• use the resource to create a competing product;

• extract individual illustrations or design elements for use in another commercial product;

• publish the resource online or make it publicly downloadable;

• substantially alter and resell the resource; or

• use the resource in a way that infringes our intellectual-property rights.

 

Printed copies may be given to your own learners for personal learning purposes, but learners must not reproduce, publish, sell or redistribute them.

 

6. Copyright and intellectual property

All original diagrams, illustrations, layouts, written content, animations, branding and associated materials remain the intellectual property of Auld Road Motoring Co. or the relevant identified rights holder.

Copyright is not transferred when a resource is purchased.

“Auld Road Motoring Co.” and associated branding may not be used without prior written permission.

 

7. Orders, prices and payment

Prices are shown on the relevant product page and may change at any time. A price change will not affect an order that has already been completed. Payments and digital delivery may be processed through Payhip and its supported payment providers. Their own platform and payment terms may also apply.

You are responsible for providing an accurate email address and completing payment successfully. Your order is accepted when payment has been confirmed and the digital resource is made available to you.

 

8. Digital delivery

Digital products are normally made available for download shortly after successful payment.

Please download and securely store your purchased files. Although we may assist with replacement access, we cannot guarantee that every product or download link will remain available indefinitely.

Where a download email does not arrive, please check your junk or spam folder before contacting us.

If you experience a genuine delivery or technical problem, contact us at rocktigerdesign@gmail.com with your name, order email address and order number.

 

9. Cancellation and refunds

Digital resources are supplied with immediate access. Where required during checkout, you will be asked to consent to the immediate supply of the digital content and acknowledge that your statutory right to cancel may be lost once downloading or access begins.

Because digital files cannot ordinarily be returned after they have been accessed, we do not normally offer refunds for:

• changing your mind after downloading the resource;

• purchasing the wrong resource;

• failing to read the product description;

• lacking compatible software or equipment where the required format was clearly stated; or

• no longer requiring the resource.

 

However, this does not affect your statutory consumer rights.

Please contact us where:

• the file is faulty or corrupted;

• you received the wrong product;

• the product is materially different from its description;

• you cannot access the product because of a problem for which we are responsible; or

• you accidentally purchased the same product more than once.

 

We will first try to resolve the problem by supplying a working or corrected file. Where that is not reasonably possible, an appropriate refund or other remedy may be offered in accordance with applicable consumer law. Nothing in these terms excludes rights that cannot legally be excluded.

 

10. Updates and changes to resources

We may occasionally correct, improve or update a resource. Unless a product page expressly includes continuing updates, purchasing a resource does not guarantee:

• lifetime updates;

• monitoring of future road-layout changes;

• replacement whenever signs or speed limits change;

• access to future editions; or

• individual customization.

 

We may provide minor corrections or updated files to previous customers at our discretion. A substantially revised or expanded version may be sold as a separate product.

 

11. Customer responsibility

You are responsible for:

• checking that the resource is suitable for your intended teaching use;

• reviewing location-based information before relying on it;

• checking current signs, markings, restrictions and speed limits;

• using professional judgement when teaching;

• keeping your files and download details secure; and

• ensuring anyone shown a resource understands that live road conditions take priority.

 

The purchaser remains responsible for how the resource is presented and used during instruction.

 

12. Limitation of liability

We take reasonable care when preparing our resources, but we do not guarantee that location-based information will remain complete, current or free from minor errors.

 

To the fullest extent permitted by law, we will not be responsible for losses arising solely from:

• a road alteration made after the resource was checked;

• reliance on the resource instead of current roadside information;

• use of the resource outside its intended educational purpose;

• unauthorised modification or redistribution;

• incompatibility that was clearly explained before purchase; or

• a customer’s failure to use reasonable professional judgement.

 

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Where permitted by law, our total liability relating to a purchased resource will not exceed the amount paid for that resource.

 

13. Suspension or termination of the license

We may suspend or terminate your license where we reasonably believe that you have:

• shared or redistributed a digital file;

• resold or copied a resource;

• used the resource to produce a competing commercial product;

• breached our intellectual-property rights; or

• materially breached these terms.

 

Termination does not transfer ownership of the resource or permit continued unauthorized use.

 

14. Website use

You may browse and use our website for lawful purposes. We may update, suspend or withdraw parts of the website without notice.

You must not:

• attempt to gain unauthorized access to the website or its systems;

• knowingly introduce malicious software;

• scrape, copy or systematically reproduce website content;

• interfere with the website’s operation; or

• use website content in a misleading or unlawful way.

 

15. Third-party services and links

Our website may link to Payhip, payment providers, map services, government information or other third-party websites. We do not control those services and are not responsible for their availability, content, privacy practices or separate terms. A link does not necessarily mean that we endorse all content provided by that third party.

 

16. Privacy

Personal information is handled in accordance with our Privacy Policy. Payhip and payment providers may separately process information needed to complete purchases and deliver products under their own privacy policies.

 

17. Changes to these terms

We may amend these terms to reflect changes to our products, business practices, technology or legal obligations. The terms applying to a purchase will normally be those published when the purchase was made. Changes will not remove statutory rights relating to an earlier purchase.

The latest version will be available on our website.

 

18. Governing law

These terms are governed by the laws of Scotland. If you are a consumer living elsewhere, you may also benefit from mandatory consumer protections under the laws of the country in which you live. The Scottish courts will have jurisdiction, subject to any rights you have as a consumer to bring proceedings in another applicable jurisdiction.
